1. Introduction

Build AI Studios ("Company," "we," "our," "us") operates the CLARA service (Call Lead Automation & Response Agent). This Privacy Policy explains how we collect, use, disclose, and safeguard information when callers interact with the CLARA voice system, when callers receive appointment-related SMS messages, and when business owners ("Subscribers") use our service. This policy applies to all users regardless of location within the United States.

2. Information We Collect

Information Collected During Calls

  • Caller's name (as provided verbally)
  • Caller's phone number (as provided verbally and via caller ID)
  • Service or job type requested
  • Urgency level of the request
  • Appointment preferences (requested dates, times, and scheduling changes)
  • Appointment confirmations, reschedules, and cancellations communicated via call or SMS
  • Call audio recordings and transcripts
  • Call metadata (date, time, duration)

Information Collected from Subscribers

  • Business name and contact information
  • Phone number(s) used with the service
  • Billing and payment information
  • Account credentials
  • Calendar and scheduling data when calendar integration is enabled

Automatically Collected Information

  • IP addresses when visiting yourclara.com
  • Browser type and device information
  • Pages viewed and interactions on our website

3. How We Use Your Information

We use collected information for the following business purposes:

  • Qualifying inbound leads and notifying Subscribers via SMS
  • Scheduling, confirming, rescheduling, and canceling appointments on behalf of Subscribers
  • Sending appointment reminders and confirmations to callers via SMS
  • Processing and delivering call transcripts and summaries
  • Improving voice agent accuracy and call handling quality
  • Billing and account management
  • Responding to customer support inquiries
  • Complying with legal obligations

We do NOT use caller information for marketing, advertising, or profiling purposes.

4. Call Recording, AI Disclosure, and SMS Communications

AI Disclosure

CLARA is an AI-powered voice assistant that uses speech recognition, natural language processing, and text-to-speech technology. CLARA is not a human voice agent. Callers are informed that they are interacting with an automated system through the call greeting.

Call Recording

Calls handled by CLARA are recorded and transcribed to extract lead information and to improve service quality. By continuing a call after the initial greeting, callers acknowledge that the call may be recorded. Business owners who subscribe to CLARA are responsible for ensuring any additional call recording disclosures required by their state are included in their greeting or call forwarding setup.

Two-party consent states: Several U.S. states, including California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, New Hampshire, Oregon, Pennsylvania, and Washington, require all parties to consent to call recording. CLARA's greeting includes language designed to provide notice to callers. Subscribers operating in two-party consent states should consult with legal counsel to confirm their specific obligations.

SMS to Callers

With the Subscriber's authorization, CLARA may send SMS messages to callers for the purpose of confirming, reminding about, rescheduling, or canceling appointments. Callers who receive these messages may opt out at any time by replying STOP. Message frequency depends on appointment activity, typically 1 to 3 messages per appointment. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

SMS Communications to Subscribers

When you sign up for CLARA, you consent to receive automated SMS text messages to your registered business phone number. These messages include:

  • Lead notifications when CLARA handles an incoming call
  • Appointment confirmations and reminders
  • Service updates and account notifications

Message frequency varies based on your call volume. Message and data rates may apply.

You may opt out at any time by replying STOP to any message. Reply HELP for assistance. For support, contact support@yourclara.com.

By providing your phone number and checking the SMS consent box during signup, you expressly consent to receive these automated messages. This consent is not a condition of purchase.

5. Data Sharing and Disclosure

We do not sell, rent, or trade personal information to third parties. We do not share personal information for cross-context behavioral advertising.

We may disclose information in the following limited circumstances:

  • To the Subscriber whose business number received the call (the lead notification and appointment details)
  • To third-party service providers who assist in operating our service (see Section 6)
  • To comply with applicable laws, regulations, or legal process
  • To protect the rights, safety, or property of our Company, Subscribers, or others
  • In connection with a merger, acquisition, or sale of assets (with notice to affected parties)

6. Third-Party Service Providers

CLARA uses the following third-party services to operate. Each maintains its own privacy practices:

  • Retell AI (retellai.com): Voice AI processing, speech-to-text, text-to-speech
  • Twilio (twilio.com): Telephony infrastructure and SMS delivery
  • Anthropic (anthropic.com): AI language processing for lead data extraction
  • Railway (railway.com): Application hosting

We require service providers to protect personal information and use it only for the purposes we specify.

7. Data Retention

  • Call recordings and transcripts: retained for 90 days from the date of the call, then automatically deleted
  • Lead notification data (name, phone, job type, urgency): retained for the duration of the Subscriber's active account
  • Appointment and scheduling data: retained for the duration of the Subscriber's active account
  • Upon account cancellation: all associated data is deleted within 30 days
  • Billing records: retained for 7 years as required by tax and accounting regulations

8. Data Security

We implement industry-standard technical and organizational safeguards to protect personal information, including encryption of data in transit (TLS/SSL), access controls, and secure hosting infrastructure. No method of electronic transmission or storage is completely secure. We cannot guarantee absolute security but are committed to protecting your information using commercially reasonable measures.

9. Your Privacy Rights

All U.S. Residents

  • Request information about what personal data we hold about you
  • Request correction of inaccurate personal data
  • Request deletion of your personal data
  • Opt out of any future data collection related to your interactions with our service

California Residents (CCPA/CPRA Rights)

If you are a California resident, you have the following rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act:

  • Right to Know: You may request the categories and specific pieces of personal information we have collected about you, the sources, the business purposes for collection, and the categories of third parties with whom we share it.
  • Right to Delete: You may request that we delete personal information we have collected from you, subject to certain legal exceptions.
  • Right to Correct: You may request correction of inaccurate personal information.
  • Right to Opt-Out of Sale/Sharing: We do not sell or share personal information for cross-context behavioral advertising. No opt-out is necessary because this activity does not occur.
  • Right to Limit Use of Sensitive Personal Information: We collect phone numbers and voice recordings which may be considered sensitive. We use this information only for the disclosed business purposes of lead qualification, appointment scheduling, and notification.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights.

To submit a request, email hello@yourclara.com with "Privacy Request" in the subject line. We will verify your identity and respond within 45 days. If we need additional time, we will notify you of the extension (up to 90 days total). You may designate an authorized agent to submit requests on your behalf by providing written authorization.

Virginia, Colorado, Connecticut, and Other State Residents

Residents of states with comprehensive privacy laws (including Virginia, Colorado, Connecticut, Oregon, Texas, Montana, Delaware, Iowa, New Hampshire, New Jersey, Nebraska, Minnesota, Maryland, Indiana, Kentucky, Rhode Island, and Tennessee) may have additional rights including the right to access, correct, delete, and opt out of certain processing activities. To exercise these rights, contact us at hello@yourclara.com. If we decline your request, you may appeal by emailing hello@yourclara.com with "Privacy Appeal" in the subject line. We will respond to appeals within 60 days.

10. Automated Decision-Making Technology (ADMT)

CLARA uses artificial intelligence to process voice calls and extract lead information. This automated processing determines what information is included in the lead notification sent to the Subscriber. When calendar integration is enabled, CLARA may use AI to suggest and confirm appointment times. No automated decisions made by CLARA have legal or similarly significant effects on callers. Callers who wish to interact with a human rather than an AI system should contact the business directly through alternative means.

11. Children's Privacy

CLARA is not directed at children under 16 years of age. We do not knowingly collect personal information from children under 16. If we learn that we have inadvertently collected information from a child under 16, we will delete it promptly. If you believe a child has provided us with personal information, please contact us at hello@yourclara.com.

12. Do Not Sell or Share My Personal Information

We do not sell personal information. We do not share personal information for cross-context behavioral advertising. Because we do not engage in these activities, no opt-out mechanism is required. If our practices change, we will update this policy and provide appropriate opt-out mechanisms before any such change takes effect.

13. Universal Opt-Out Mechanisms

We respect browser-based and device-based universal opt-out preference signals, including the Global Privacy Control (GPC). When we detect a GPC signal from your browser while visiting yourclara.com, we treat it as a valid request to opt out of the sale or sharing of personal information associated with that browser. Because we do not sell or share personal information, the GPC signal serves as confirmation that no such activity will occur.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last Updated" date at the top and, where required by law, provide notice to affected parties via email or SMS. Continued use of our service after changes are posted constitutes acceptance of the updated policy.
